Successor

Membership Requirements

 

1.  Duly accomplished and signed Application Form; 
2.  Photocopy of government-issued ID; 
3. 

Updated list of works of the deceased composer (with tapes/CDs) 

4. 

Copy of any of the following: 

  • Probated last will and testament signed by the deceased composer; 
  • Duly accomplished, signed, and notarized Judicial Settlement or Extra Judicial Settlement document if the member died intestate  
5.  Duly accomplished, signed, and notarized Special Power of Attorney (SPA) document in cases where there are several heirs

If the predecessor composer was not a FILSCAP member at the time of death:  

Proof of any of the following: 

a.  That an original composition of the applicant was recorded as part of a commercially-released movie or film that has been publicly exhibited in any FILSCAP-licensed cinema or venue (e.g. copy of the movie or film with credits, or certification from the movie producer); 
b.  That an original composition of the applicant was publicly played at least three (3) times in the last twelve (12) months in any FILSCAP-licensed establishment, venue or event, excluding FILSCAP events (e.g., videos of recent performance or certification by the manager of the establishment); 
c.  That an original musical composition of the applicant is being publicly played or broadcasted on any FILSCAP-licensed TV, cable or radio station, excluding FILSCAP-initiated radio guesting (e.g. recordings of the broadcast, or certification of use from the station); 
d. 

That an original composition of the applicant is available, or being made available, for downloading or streaming on a FILSCAP-licensed website, app or digital service. 

d.1. In the case of streaming services, the composition must have been played a significant number of times in the past year. For Spotify, the number of streams should be greater than or equal to 1,000. 

d.2. In the case of YouTube and other FILSCAP-licensed digital services whose license fees are based on ad revenue must satisfy the following conditions: 

   – Composition is in a monetized video;
   – Video must be claimable and not solely available on the applicant’s personal channel under the YouTube Partner Program; and
   – Composition/s has/have a claimable royalty from YouTube amounting to PhP100 (to be determined by FILSCAP upon review of the usage data file from YouTube) 

 

If the predecessor composer was a FILSCAP member at the time of death: 

 

FILSCAP will check if there is adequate monitoring data which will satisfy any of the above-mentioned proof of performance requirements for any of the works of the late member.

In cases wherein there is no available monitoring data, or if the available monitoring data does not satisfy the any of the criteria, the successor applicant must then provide the necessary documentation to show proof for any of the above.   

   

 

5. 

Five (5) copies of duly signed and notarized Deed of Assignment (to be executed as soon as the FILSCAP Board confirms the eligibility of the applicant to become a FILSCAP member.) 

Note: The Deed of Assignment requires the applicant to assign his/her predecessor’s public performance and communication to the public rights (i.e., the right to authorize or license the public playing and communication to the public) over his/her predecessor’s musical compositions to FILSCAP. The assignment will be effective only for as long as the applicant is a member of FILSCAP. Accordingly, the assigned rights will revert to the applicant if he/she ceases to be a member of FILSCAP; & 

6.  Payment of Php 300.00 admission/processing fee and Php 150.00 annual membership fee (to be paid within 60 days upon admission of membership.)
