Membership Requirements

a.

For Corporation

1. SEC Registration Certificate
2. Articles of Incorporation (must be stated in the primary or secondary purpose that the company is engaged in the publishing business)
3. By-Laws
4. BIR Registration Certificate
5. Taxpayer Identification Number (TIN)
6. Current Business and Mayor’s Permits
7. BIR ruling that income from royalty is considered as active rather than passive
(if any)
8. Board Resolution authorizing Company Representative
9. Must have at least 5 works in the catalogue wherein at least one work satisfies any of the indicated proofs of usage of any of our licensees

 
b.

For One-Person Corporation

1. SEC Registration Certificate
2. Articles of Incorporation (must be stated in the primary or secondary purpose that the company is engaged in the publishing business)
3. By-Laws
4. BIR Registration Certificate
5. Taxpayer Identification Number (TIN)
6. Current Business and Mayor’s Permits
7. BIR ruling that income from royalty is considered as active rather than passive
(if any)
8. Director's Resolution authorizing Company Representative
9. Proof of being operational for at least 1 year or proof of royalty payments to composer/s
10. Must have at least 5 works in the catalogue wherein at least one work satisfies any of the indicated proofs of usage of any of our licensees

 
c.

For Partnership

1. SEC Registration Certificate
2. Articles of Co-partnership / Partnership
3. Taxpayer Identification Number (TIN)
4. Current Business and Mayor’s Permits
5. Board Resolution authorizing Company Representative
6. Proof of being operational for at least 1 year or proof of royalty payment/s to composer/s
7. Must have at least 5 works in the catalogue wherein at least one work satisfies any of the indicated proofs of usage of any of our licensees
d.

For Sole Proprietorship
  1.  DTI Certificate of Registration
  2.  Taxpayers Identification Number (TIN)
  3.  Current Business and Mayor’s Permits
  4.  Special Power of Attorney (SPA) authorizing Company Representative
  5.  Proof of being operational for at least 1 year or proof of royalty payment/s to composer/s
  6.  Must have at least 5 works in the catalogue wherein at least one work satisfies any of the indicated proofs of usage of any of our licensees

Proof of any of the following:

a. That an original composition of the applicant was recorded as part of a commercially-released movie or film that has been publicly exhibited in any FILSCAP-licensed cinema or venue (e.g.,copy of the movie or film with credits, or certification from the movie producer);

b. That an original composition of the applicant was publicly played at least three (3) times in the last twelve (12) months in any FILSCAP-licensed establishment, venue or event, excluding FILSCAP events (e.g., videos of recent performance or certification by the manager of the establishment);

c. That an original musical composition of the applicant is being publicly played or broadcasted on any FILSCAP-licensed TV, cable or radio station, excluding FILSCAP-initiated radio guestings (e.g., recordings of the broadcast, or certification of use from the station); or

d. That an original composition of the applicant is available, or being made available, for downloading or streaming on a FILSCAP-licensed website, app or digital service.

 

    • In the case of streaming services, the composition must have been played a significant number of times in the past year. For Spotify, the number of streams should be greater than or equal to 1,000.
    • In the case of YouTube and other FILSCAP-licensed digital services whose license fees are based on ad revenue must satisfy the following conditions:
      1. Composition is in a monetized video;
      2. Video must be claimable and not solely available on their composers’ personal channel under the YouTube Partner Program; and
      3. Composition/s has/have a projected royalty from YouTube amounting to PhP100 (to be determined by FILSCAP upon review of the usage data file from YouTube)

Updated List of songwriters and assigned works/songs
6.

Any Government Issued ID of the Company Representative
7.

Payment of P 1,000.00 entrance fee and P1,500.00 annual membership fee (to be paid after admission as a member).
